The expressions and terms used in these General Terms and Conditions shall have the meanings attributed to them below:

Refers to the right of admission to an Event organised by the Organiser on the Site.

Refers to the personal account created on the Site when a Ticket is purchased.

means the individual event or events promoted on the Tiks Asia Site for which tickets are available.

means any legal entity or individual purchasing Tickets on the Site to participate in an Event

Tiks Asia is a digital ticketing Plateform that allows the Organiser to promote and sell Tickets for its Events. At no time do we purchase Billets, set the price of Billets or determine the conditions of sale for each Event, this is the responsibility of the Organiser.

We simply collect the money from the Tickets on behalf of the Promoter and provide the Promoter with the details of your booking, as well as the revenue from the Tickets.  Tiks Asia will charge you a booking fee for this service.  Ownership of Tickets and the right to grant entry to the Event remains with the Event's Organiser and is not transferred to Tiks Asia at any time.

These General Conditions apply to the exclusion of all other conditions. They are accessible at all times on the Site and will prevail, where applicable, over any other version or any other contradictory document. You declare that: 

	•	Have read and accepted these Terms and Conditions before registering for the Event. 

	•	Have full legal capacity to enter into commitments under these General Terms and Conditions.

	•	Be of legal age and not under any form of protection or guardianship. 

Client selects the Event they wish to order directly on the page reserved for them when browsing the Site. They must then create a Personal account on Site and consequently undertake to : 

	•	Provide true, accurate, current and complete information as requested in the Site registration form;

	•	 Maintain and promptly update registration data so that it remains true, accurate, up-to-date and complete.

Any order placed on the Site by the Client constitutes the formation of a contract concluded remotely between the Client and Tiks Asia.

The information provided by the Client when placing the order is binding. Tiks Asia or the Organiser may in no way be held liable if an error in placing the order prevents the Client from taking part in the Event.

The Client is informed that the Organiser may modify, add, withdraw or replace the artists, prizes, date, venue, capacity, age restrictions and timetables of the Event without prejudice to the latter.

The sale of Tickets will only be considered definitive once Tiks Asia has sent the Client confirmation of acceptance of the order by e-mail and once the Client has received the full price. 

Once the order has been validated, the Customer may modify the information entered to access the Event on his Personnal account. 

In particular, he/she may change the rname/first name of the person mentioned on the Ticket in the event of sale or transfer (whether free of charge or in return for payment). 

In this case, a service charge may be applied by the Organizer or Tiks Asia, and the Customer must take this into account before making any changes

Given the nature of the Event, no cancellation of the order by the Client will be possible once it has been confirmed by Tiks Asia and following the wishes of the Organiser, subject to the provisions of Article 4.

Tiks Asia reserves the right to cancel or refuse any order from a Client with whom there is a dispute relating to the payment of a previous order on the Site. 

Payment for the order can be made as follows when the order is placed: 

The Client is hereby informed that the undertaking to pay given by bank card is irrevocable. 

By providing his/her bank details when placing an order, the Client authorises Tiks Asia to debit his/her card for the amount relating to the price indicated. The Client confirms that he/she is the legal holder of the card to be debited and that he/she is legally entitled to use it. 

Payments are made via an independent payment service provider that uses the TLS (Transport Layer Security) protocol. 

Tiks Asia cannot be held responsible in the event of fraudulent use by third parties of the means of payment used. The independent payment provider assumes full responsibility for the security of its system. 

Tiks Asia reserves the right to suspend or cancel access to the Event in the event of non-compliance with the above payment conditions. Under no circumstances may the Client request any compensation or reimbursement in this respect. 

Payments made by the Client will not be considered final until Tiks Asia has received the sums due.

Tickets are supplied at the prices in force on the Site when the order is placed. Prices are inclusive of all taxes. The prices take into account any discounts granted by the Organiser.

These prices are firm and non-revisable during their period of validity, as indicated on the Site, the Organiser, via Tiks Asia, reserving the right, outside this period of validity, to modify them at any time. 

This refund policy is established by the Organiser, who remains solely responsible to the Client. Tiks Asia acts only as an intermediary. 

The Organiser agrees to refund the Client acknowledges if an Event is cancelled or does not take place. The amount refunded will be the total price of the Ticket less the cost of processing the refund. Booking fees paid at the time of purchase will not be refundable.

If the Client requests a total or partial refund, the Client must contact the Organiser, who will examine the situation on a case-by-case basis. The decision whether or not to refund all or part of the price of the Ticket will be taken at the sole discretion of the Organiser of the Event.

Refunds can only be made by the same method of payment used for the original purchase. If the Tickets have been transferred, the new holder of the Tickets must contact the original purchaser of the Tickets to obtain a refund if the transfer was made following a sale.

Access to the Event is subject to the terms and conditions determined solely by the Organiser. Tickets are issued subject to the rules and regulations of the Event, as published by the Organiser and the venue.  Full details are available on request from the Organiser. The Client, and more generally all other Ticket holders, must comply with all laws, safety announcements and regulations of the venue.

The Customer is informed that in the event of exchange or resale of the Ticket, the Customer must make the necessary modifications on his Personal account under his sole responsibility. The Organizer and/or Tiks Asia cannot be held liable if the Customer fails to comply with these obligations. 

Furthermore, the printing of multiple Tickets with different personal information is strictly forbidden. A single Ticket gives access to the Event for one person only. In such a case, the Organizer reserves the right to refuse access to the Customer without prejudice to the latter.

To access the Event, the Client must present : 

	•	His printed or dematerialised Ticket. 

All minors must be accompanied by an adult who will be solely responsible for them.

Furthermore, the Client undertakes not to bring to the Event : 

	•	Illegal, dangerous or prohibited products; 

	•	Professional recording equipment without the express written authorisation of the Organiser. 

In the event of failure to comply with the obligations described above, the Organiser may refuse entry or expel the Client in the event of anti-social behaviour, or any other activity deemed inappropriate, without prejudice to the Client.

Tiks Asia may, at its sole discretion may cut off the Client’s access to his Personal account and /or prohibit access to the Site at any time, for any reason whatsoever and in particular in case of lack, failure to pay on time any sum due, or if Tiks Asia considers that the Client has violated or acted in a manner incompatible with these Terms and Conditions against the letter or spirit of them.

All texts, comments, works, illustrations, images and photographs, videos, brands and databases reproduced and integrated on the Site are the exclusive property of Tiks Asia or the Organiser and are protected by international laws relating to intellectual property.

Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright.

ARTICLE 2 - COLLECTION AND PROCESSING OF PERSONAL DATA 

The Personal Data communicated by the User to the Data Controller is subject to computer processing and is kept and used by the Data Controller for the purposes described in the aforementioned article and concerns :

Identification data (surname, first name, e-mail address, telephone number, postal address);

Connection data and cookies (IP addresses, connection logs) ;

Registering and managing subscriptions to organised events and providing the corresponding services;

Communication with Users in order to respond to their requests and enquiries;

Sending the User newsletters, information messages and promotional offers.

In particular, the Data Controller may collect personal data: 

When the User registers and creates a personal account on the Site ;

During exchanges with the Data Controller or its teams via the Site or by telephone ;

Furthermore, when the User visits the Site, browsing data may be collected and processed by the Data Controller or by any service provider of its choice for statistical purposes, in order to improve the use of the Site, and in particular to measure the number of pages viewed, the number of visits and the User's browsing path on the Site.

Some of the processing carried out by the Data Controller in accordance with the purposes set out above is necessary to enable it to :

Fulfil its contractual obligations to certain Users;

To meet certain legitimate interests relating in particular to its management.

In all other cases, the processing carried out by the Data Controller is possible insofar as the User has expressly consented to it.

The Data Controller shall take all appropriate technical and organisational measures to ensure the security of the User's Personal Data, in particular against the loss, alteration, distribution or unlawful use of such data.

The Data Controller shall ensure that such measures are put in place for all operations carried out in the context of processing, and in particular during the collection of Personal Data, its storage and hosting.

The User's Personal Data may be communicated to third-party subcontractors of the Data Controller to ensure access to and use of the Site and the smooth running of the event it is organising.

The User's Personal Data will not be communicated or transferred to third parties for commercial or promotional purposes, except : 

Prior express agreement from the User or information 

Via the completion of an online form by the User, which is subject to their prior and express agreement by means of a corresponding clickable button accessible when they are invited to provide Personal Data. 

If the User no longer wishes to receive them, they can unsubscribe at any time by sending a request to the Data Controller:

In certain cases, the Data Controller may communicate the User's Personal Data to any administrative or judicial authority that so requests, in accordance with current legislation.

The information communicated may be transferred abroad for the purpose of fulfilling the contractual obligations to which the Data Controller is subject.

ARTICLE 7 - RETENTION PERIOD FOR PERSONAL DATA

The Data Controller will only keep the User's Personal Data for a limited period, determined according to the nature of the data in question and the processing concerned.

On this basis, the User's Personal Data will be kept for the following periods:

Identification data: 36 months from the last connection 

Prospective customers: 12 months from the last activity on the Site.

In general, Personal Data is collected for a limited period of 3 years after the closure of the User's file. 

Once these periods have elapsed, some of the Personal Data in question may be archived for the purposes of accounting management and the management of disputes or requisitions, for a period which may not exceed the legal requirements in these matters.

TIKS ASIA LIMITED

Tiks Asia is also the owner of, or has exclusive rights to, the Platform and to the documents, information, works, illustrations, images and photographs, videos and audio available on the platform. No transfer of intellectual property rights is made through these General Terms and Conditions.

This Legal Notice supplements the provisions applicable to the relationship between the Provider, the Organiser and the user, and must therefore be read in conjunction with the other applicable conditions accessible from the Website. 

In principle, the Website is accessible to users 24 hours a day, 7 days a week, unless it is interrupted, whether scheduled or not, for maintenance purposes or in the event of force majeure. 

In the event that access to the Site is impossible, the latter undertakes to do its utmost to restore access. The Organiser and the Provider may not be held liable for any damage whatsoever resulting from the unavailability of the Site. 

The Organiser and the Provider may use cookies to process traffic statistics and information, facilitate browsing and improve the service for the user's convenience.

Browsing the Site may cause cookies to be installed on the user's computer. ARTICLE 5 - MODIFICATION OF THE LEGAL NOTICE 

These legal notices may be modified at any time. These modifications are published when they are put online and are deemed to have been accepted without reservation when the user accesses the Site after they have been put online. 

ALL DISPUTES TO WHICH THESE TERMS AND CONDITIONS MAY GIVE RISE, CONCERNING THEIR VALIDITY, INTERPRETATION, PERFORMANCE, TERMINATION, CONSEQUENCES AND CONSEQUENCES, SHALL BE SUBMITTED TO THE COMPETENT COURTS IN THE JURISDICTION IN WHICH THE USER'S PLACE OF RESIDENCE IS LOCATED.

ARTICLE 7 - RETENTION PERIOD FOR PERSONAL DATA 

In accordance with the PDPO, the User has the right to access, rectify, erase or delete all or part of his or her Personal Data, the right to object, and the right to limit the processing and portability of his or her Personal Data, which he or she may exercise by sending a letter to the Data Controller :

For processing based on the collection of the User's consent, the User also has the right to withdraw his/her consent at any time.

The User is advised that the exercise of these rights does not affect the validity of the processing operations carried out previously, nor the right of the Data Controller to archive some of the Personal Data in question, in accordance with the principles set out above. Such requests must be made by the User personally and in writing, signed and accompanied by a photocopy of an identity document bearing the signature of its holder. 

This information will only be used to identify the User and will not be kept for longer than is necessary to process the response. The request shall specify the e-mail or postal address to which any reply should be sent. The Data Controller will have thirty (30) days to respond following receipt of the request. 

A cookie is a file sent by a website when it is visited and stored in web browsers.

Generally speaking, cookies are used to measure and evaluate the behaviour of Users who visit a website (number of visitors, length of visits, items most frequently consulted, etc.). There are several types of cookies, some of which are non-identifying and others which are identifying. The Data Controller uses cookies when the User browses the Site. The cookies used by the Data Controller are stored for a maximum period of 13 (thirteen) months from the time they are first placed on the User's computer.

The Data Controller is in no way responsible for operations linked to the use of third-party cookies. The User has the option of configuring the operation of cookies installed on their computer by configuring their browser settings. If the User chooses to deactivate or block certain cookies, the functionalities associated with them (for example, personalising the browsing experience on the Site) cannot be applied.

The Site is up to date with the latest regulations in terms of cookie policy. 

ARTICLE 10 - MODIFICATION OF CONFIDENTIALITY POLICIES

These Confidentiality Policies may be amended by the Data Controller at any time. In the event of a change to the Confidentiality Policies, the new version in force will apply to the User from the time of connection to the Site.

In the event of a dispute between the User and the Data Controller, the Privacy Policy to be taken into account will be that in force at the time of the events giving rise to the dispute. 

These terms and conditions are governed by and subject to the laws of Hong Kong, and in particular the provisions of the Personal Data (Privacy) Ordinance, Chapter 486 of the Law of the Hong Kong Special Administrative Region.
